Graphic & illustration commission terms and conditions
Below are the default terms and conditions for art and graphic design commissions. These standard terms may be subject to edits based on specific project requirements. DVA Projects will make any necessary modifications before sending the final contract.
Please note: If you have hired DVA Projects on a project basis, you should also review these terms and conditions.
From this point forward, the term ‘graphic’ shall refer to both graphics and illustrations.
General
- Scope of Work: The services provided by DVA Projects will be detailed in the project agreement, including specific deliverables, timelines, and any applicable milestones.
- Non-Disclosure Agreement (NDA): All information shared between the client and DVA Projects shall remain confidential. Neither party will disclose any proprietary information without prior written consent from the other party.
- Clients hiring DVA Projects on a project basis are also subject to these terms and conditions, ensuring consistency across all engagements.
- Any additional services requested beyond the initial agreement will be subject to a new or amended contract and may incur additional charges.
- DVA Projects will not be held liable for any damages arising from the use of the commissioned work beyond the scope outlined in the agreement.
- By commissioning DVA Projects, the client agrees to these terms and conditions. Any changes or additions to these terms must be documented in writing and signed by both parties.
Payment
- Payments, if outside of the EU, exclusively occur through PayPal and in € Euro’s.
- 50% of the payment is, unless specified otherwise, required up-front.
- Payment schedules, including any deposits, will be outlined in the project agreement. Full payment is required before the final delivery of the commissioned work.
Delivery time
- The time it takes to finish the commission may vary between 1 week to 1 month depending on the complexity of the work. This will be specified at the start date of the project, which may not always be right away.
Delivery includes
- Simple, and transparent background.
- A total of 4 revisions at two different stages right after the initial sketches/concepts and right after the flat coloring phase.
- You receive .jpg, .png and .pdf files, you do not usually receive the source file.
- Any other files or specifications you may need can be discussed.
- Files are sent through WeTransfer.
Licensing
- The final graphics will be transferred to the client upon full payment, unless otherwise specified. DVA Projects retains the right to use the work for portfolio and promotional purposes unless an NDA specifies otherwise.
- You cannot edit the graphics or illustrations other than changing size, flipping, zooming in or adding/removing backgrounds unless specified otherwise.
- Unless otherwise specified, this contract includes the non-exclusive rights for the artwork. You can use the art for promotion, but you cannot monetize or resell it. Using it as a background/intros/outros or educational purposes on social media channels like Youtube and Twitch, which are then monetized is fine.
- You are free to post the graphics to websites and social media channels. Using the signed version or referring to me is very much appreciated, but not required.
- DVA Projects does not claim the intellectual property (IP) of the commissioned graphics.
- DVA Projects will never agree to graphics being used for the following topics*: politics, bullying, abuse, and racism. These topics must be fully unbiased and educational to be approved. A clause will be added to clarify. *Additional Clause: DVA Projects reserves the right to refuse projects related to the specified topics unless they are presented in an unbiased and educational manner and have been approved by DVA Projects.
- You can use the graphics for any of the specified projects.
- Monetizing the graphics can be discussed and will be specified. This may or may not include selling you additional rights.
- You cannot edit the image other than: Adding text, flipping the canvas, adding a frame, or zooming in.
- DVA Projects keeps the rights of the image (Industry standard) unless specified otherwise.
Cancellation and refund policy
- Policies regarding cancellations and refunds will be detailed in the project agreement. Typically, deposits are non-refundable.
- If for any reason DVA Projects is unable to start your commission, you will receive a full refund.
- If you cancel your order before DVA Projects started with the commission, DVA Projects will refund 50% of the deposit.
- If you receive a fund back, and you used Paypayl do not request a Paypal chargeback. The money will be transferred to you.
